How to prepare for a probate consultation

Probate cases can vary, the two most common types are below, please review each to determine what might be needed in your particular situation:


I need to probate an estate for someone that has passed away:

  • When did that person pass?

  • Is there a will and/or trust?

  • Who is named Personal Representative in the will?

  • Who is named Trustee? (if applicable)

  • What kind of assets were owned by the deceased?

  • Did the deceased have a living spouse, children, brothers/sisters?

  • A copy of the will or trust sent to our office prior to your appointment is not required but would be helpful


I am an heir/beneficiary and I need to contest a probate estate being handled by someone else:

  • When did the deceased pass away?

  • Is there a will and/or trust? A copy of the will or trust sent to our office prior to your appointment is not required but would be helpful.

  • What are you contesting about the estate? Note that your attorney will not be able to analyze your situation if you do not provide any paperwork for your attorney to review during your appointment time.

  • Why do you think this estate has been administered incorrectly?


It's important to make sure you are honest during any probate consultation so that your attorney can best assist and advise you. Note that probate cases are complicated and a full analysis may not be possible without full reviewing the case file which will require retaining the attorney.
